Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Software4You ("Flow Chat", "we", "us", or "our") governing your access to and use of the Flow Chat mobile application and related services (together, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

• You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority where you live, you confirm you have permission from a parent or legal guardian.
• You may use certain features anonymously, or create an account using an email sign-in link or Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
• You agree to provide accurate information and to promptly notify us of any unauthorized use of your account.

2. Description of the Service

Flow Chat provides real-time speech-to-text, text translation, and chat features so that people speaking different languages can communicate. Depending on the mode you select, translation and transcription may be performed on-device (Google ML Kit), by Apple's speech services, or by sending audio or text to third-party AI providers (Google Gemini, OpenAI) or our translation backend, as described in our Privacy Policy. Features, languages supported, and usage limits may change over time and may vary between the Free and Pro tiers.

3. Acceptable use

When using the Service, you agree that you will not:

• Use the Service for any unlawful purpose, or to harass, abuse, threaten, defame, or invade the privacy of any person.
• Upload, transmit, or generate content that is illegal, hateful, sexually explicit involving minors, violent, or infringes another person's intellectual property or privacy rights.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to reverse engineer, decompile, or disassemble the app, or circumvent usage limits, subscription checks, or security features (including Firebase App Check).
• Use automated means (bots, scrapers) to access the Service, or interfere with or disrupt the integrity or performance of the Service or its backend infrastructure.
• Use the contacts or invitation features to send unsolicited messages (spam) to people who have not agreed to receive them.
• Resell, sublicense, or commercially exploit the Service without our prior written consent.

We may investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending access, and reporting to law enforcement.

Reporting and blocking. Every message in a Flow session can be reported, and any participant can be blocked, from inside the app: press and hold a message, or use the menu next to a participant's name in the participant list. Blocking removes that person's messages from your chat immediately and notifies us of the content that prompted it. You can review and undo your blocks under Settings › Blocked Users. You can also email us directly at team@software4you.dev.

How we respond. We review every report within 24 hours of receiving it. Where we find a violation of this section, we remove the offending content and eject the user who provided it, terminating their access to the Service. Reports are reviewed regardless of whether the reporter also blocked the user.

4. Your content

"Your Content" means audio, text, messages, profile information, and any other content you submit, record, or generate through the Service. You retain ownership of Your Content. By submitting Your Content, you grant us a limited, worldwide, royalty-free license to host, process, transmit, and display Your Content solely as necessary to operate, provide, and improve the Service (for example, sending your speech to a translation engine and displaying the translated result to session participants).

You are solely responsible for Your Content and represent that you have all rights necessary to share it and that it does not violate these Terms, applicable law, or the rights of any third party.

6. Subscriptions, billing & cancellation

• Flow Chat Pro is an optional recurring monthly subscription (currently $8.99/month, subject to change with notice) that unlocks unlimited translation time, unlimited hosted conversations, chat history, chat summaries, and an ad-free experience.
• Subscription payments are processed by Apple through In-App Purchase. Flow Chat does not receive or store your payment card details.
• Your subscription automatically renews each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription at any time in your Apple Account settings, or through the "Manage Subscription" option in the app.
• Except where required by law, subscription fees are non-refundable, and you will continue to have access to Pro features until the end of the current billing period after cancellation.
• We reserve the right to change subscription pricing at any time, in our sole discretion, subject to Apple's requirements for notifying subscribers of price changes. Continuing your subscription after a price change takes effect constitutes acceptance of the new price.

7. Free tier, ads & rewarded incentives

Free-tier use includes a limited amount of translation time, additional time earned by voluntarily watching rewarded ads (served via Google AdMob), and a maximum accumulated balance, as described in the app. We may adjust free-tier limits, ad availability, or rewarded amounts at any time. Ads shown to free-tier users may use contextual signals and non-tracking measurement, as described in our Privacy Policy.

8. Third-party services

The Service relies on and integrates with third-party providers, including Google Firebase (authentication, database, storage, functions, analytics/App Check), Google ML Kit, Google Gemini API, Apple speech services, OpenAI, Google AdMob, and Google Cloud Run. Your use of features backed by these providers is also subject to their respective terms of service, and we are not responsible for their acts, omissions, availability, or content.

9. Intellectual property

The Service, including its software, design, graphics, logos, and trademarks (excluding Your Content and third-party materials), is owned by Software4You or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial use in accordance with these Terms. All rights not expressly granted are reserved.

10. Suspension & termination

• You may stop using the Service and delete your account at any time from the app's Settings screen, which will delete your profile and associated session data as described in our Privacy Policy.
• We may suspend or terminate your access to the Service, in whole or in part, at any time and without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or if required by law.
• Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT TRANSLATIONS OR TRANSCRIPTIONS WILL BE ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOFTWARE4YOU AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless Software4You and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

14. Governing law & dispute resolution

These Terms are governed by the laws of your country or state of residence to the extent required by applicable consumer protection law; otherwise, and to the maximum extent permitted by law, these Terms are governed by the laws applicable to Software4You, without regard to conflict-of-law principles. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer in your jurisdiction. Any dispute arising out of these Terms will first be attempted to be resolved informally by contacting us at the email address below.

15. Apple-specific terms

If you downloaded the app from Apple's App Store, you also acknowledge the following, which are required by Apple:

• These Terms are between you and Software4You only, not Apple, and Apple is not responsible for the Service or its content.
• Apple has no obligation to furnish any maintenance or support services for the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price paid through Apple's App Store; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims by you or a third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service or your possession/use of it infringes a third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

16. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will update the "Effective date" above and, where appropriate, notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
